In response to Texas Gov. Greg Abbott’s call for the Texas National Guard to secure the state’s southern border with Mexico, a pair of Texas Democrats is calling on President Biden to seize control of the Texas National Guard before Abbott gets his way.
Reps. Joaquin Castro and Greg Casar warn that Abbott is attempting to defy the Supreme Court’s order to allow Border Patrol agents to cut the razor wire he had installed as barriers in the Rio Grande near Eagle Pass.
“Governor Greg Abbott is using the Texas National Guard to obstruct and create chaos at the border,” Castro wrote on X. “If Abbott is defying yesterday’s Supreme Court ruling, @POTUS needs to establish sole federal control of the Texas National Guard now.”
Casar echoed Castro’s words with a similar statement of his own:
“I agree with @JoaquinCastrotx: if Abbott is defying yesterday’s Supreme Court ruling, @POTUS needs to establish sole federal control of the Texas National Guard.”

Failed Texas gubernatorial and senatorial candidate Beto O’Rourke joined in on the fun by making a similar call on Biden to take control over the Texas National Guard so Abbott is unsuccessful in keeping the razor wire installed at Eagle Pass.
In case you missed it, the Supreme Court ruled in a 5-4 decision that Border Patrol can cut the razor wire barriers that Abbott had installed at Shelby Park in Eagle Pass, pending further review of a lawsuit.
Abbott responded to the SCOTUS ruling by continuing to defend the sovereignty of Texas, ordering the National Guard to proceed with erecting razor wire barriers along the border regardless.
“This is not over,” Abbott declared. “Texas’ razor wire is an effective deterrent to the illegal crossings Biden encourages. I will continue to defend Texas’ constitutional authority to secure the border and prevent the Biden Admin from destroying our property.”

Abbott proceeded to call on the Texas National Guard to install more razor wire in defiance of the Supreme Court order. Invoking the Founding Fathers, Abbott said that Biden’s refusal to protect America’s southern border leaves Texas with no other choice but to do it itself.
“The federal government has broken the compact between the United States and the States,” Abbott wrote in a letter addressing the standoff between his state and the feds in Eagle Pass.
“The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting States, including immigration laws on the books right now. President Biden has refused to enforce those laws and has even violated them. The result is that he has smashed records for illegal immigration.”

Article II, Section 2 of the Constitution only allows the president to invoke the use of the National Guard if it becomes federalized, which can only occur with the governor’s permission. Biden could potentially get around this by invoking the Insurrection Act, some legal experts say.
